Participant Waiver & Release of Liability
Please read this document carefully before participating in any Open Gate Ranch program or activity. This waiver contains important information about your legal rights.
Texas Equine Activity Liability Act — Required Notice
Under the Texas Equine Activity Liability Act (Tex. Civ. Prac. & Rem. Code § 87.001 et seq.), an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities.
Inherent risks of equine activities include, but are not limited to: the propensity of an equine to behave in ways that may result in injury, harm, or death to persons on or around them; the unpredictability of an equine's reaction to sounds, sudden movement, unfamiliar objects, persons, or other animals; certain hazards such as surface and subsurface conditions; collisions with other equines or objects; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others.
1. Assumption of Risk
I understand and acknowledge that participation in equine activities — including but not limited to ranch sorting, horsemanship instruction, trail riding, groundwork, and related activities conducted at or through Open Gate Ranch — involves inherent risks of injury or death that cannot be eliminated regardless of the care taken by Open Gate Ranch, its officers, directors, volunteers, staff, and agents (collectively, "Open Gate Ranch").
These risks include, but are not limited to:
- Being thrown from, kicked by, bitten by, or otherwise injured by a horse or other animal
- Falls from horses or from structures on the property
- Collision with fences, gates, arena equipment, or other participants
- Unpredictable animal behavior in response to noise, movement, or other stimuli
- Ground and surface conditions including uneven terrain, mud, and debris
- Weather conditions including heat, lightning, and sudden storms
- Physical exertion and its associated risks
I voluntarily assume all such risks, both known and unknown, associated with participation in Open Gate Ranch activities.
2. Release of Liability
In consideration of being permitted to participate in Open Gate Ranch programs and activities, I, on behalf of myself and my heirs, personal representatives, and assigns, hereby release, waive, discharge, and covenant not to sue Open Gate Ranch, its officers, directors, volunteers, employees, agents, sponsors, and partners from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me while participating in any Open Gate Ranch activity, whether caused by the negligence of Open Gate Ranch or otherwise, to the fullest extent permitted by Texas law.
This release does not apply to claims arising from gross negligence, willful misconduct, or intentional acts.
3. Minor Participants
If the participant is under the age of 18, the parent or legal guardian must sign this waiver on the participant's behalf. By signing, the parent or legal guardian:
- Consents to the minor's participation in Open Gate Ranch activities
- Acknowledges and assumes all risks on behalf of the minor
- Agrees to the release of liability set forth in this document on behalf of the minor and themselves
- Agrees to supervise the minor during all activities and ensure the minor follows all safety instructions
- Consents to Open Gate Ranch collecting and using the minor's information as described in our Privacy Notice
Open Gate Ranch is committed to the safety and well-being of all minor participants. All programs involving minors are supervised by trained volunteers and staff.
4. Medical Authorization
In the event of an injury or medical emergency during participation in Open Gate Ranch activities, I authorize Open Gate Ranch personnel to seek emergency medical treatment on my behalf (or on behalf of the minor participant) if I am unable to be reached. I understand that Open Gate Ranch does not provide medical services and that I am responsible for all medical costs incurred.
I agree to disclose any relevant medical conditions, disabilities, or physical limitations to Open Gate Ranch staff prior to participation so that appropriate accommodations can be made.
5. Rules, Safety, and Conduct
I agree to follow all safety rules, instructions, and guidelines provided by Open Gate Ranch staff and volunteers at all times. I understand that failure to follow safety instructions may result in removal from the program without refund of any fees paid.
- Appropriate footwear (closed-toe, heel) is required for all equine activities
- Helmets are required for all mounted activities and will be provided if needed
- No running, loud noises, or sudden movements around horses
- All participants must follow the direction of Open Gate Ranch staff at all times
- Alcohol, drugs, and tobacco are prohibited on the property
- Respectful conduct toward all participants, volunteers, staff, horses, and animals is required
6. Photo and Media Release
I grant Open Gate Ranch permission to photograph or video record my participation (or the minor participant's participation) in program activities, and to use such images or recordings for nonprofit educational, fundraising, and promotional purposes, including on the Open Gate Ranch website and social media channels. I understand that no compensation will be provided for such use. If you do not consent to photography or recording, please notify Open Gate Ranch staff in writing prior to participation.
7. Nonprofit Program Acknowledgment
I understand that Open Gate Ranch is a 501(c)(3) nonprofit organization. All program fees, if any, are used to support the organization's charitable mission. Open Gate Ranch relies on volunteers, donors, and sponsors to provide its programs, and I acknowledge that program availability may change based on organizational capacity and funding.
Any financial contributions made to Open Gate Ranch are charitable donations and are not refundable as program fees unless otherwise stated in writing.
8. Governing Law
This waiver shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under this waiver shall be resolved in the courts of Montgomery County, Texas. If any provision of this waiver is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Acknowledgment
BY PARTICIPATING IN ANY OPEN GATE RANCH PROGRAM OR ACTIVITY, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, UNDERSTAND ITS TERMS, AND AGREE TO BE BOUND BY IT. If you are signing on behalf of a minor, you represent that you are the minor's parent or legal guardian and have the authority to execute this waiver on their behalf.
